ETS Reference Materials Archive Page
For the next 6 months we will be issuing violations under the ETS to companies for inspections opened on or before January 26th. This page has been created and will be maintained for dealing with citations made under the period of time that the ETS was in place. There may be confusion for a time as the final standard has been renumbered/re-lettered in places so the two standards do not always match up provision for provision. Maintaining the archive materials should help in resolving discrepancies between the two.
Reporting a Positive COVID-19 Test
Reporting COVID-19 positive cases: 16 VAC 25-220-40.B.8.e (temporary standard link) of the Emergency Temporary Standard (ETS) provides that “The employer shall notify the Virginia Department of Labor and Industry (DOLI) within 24 hours of the discovery of three (3) or more employees present at the place of employment within a 14-day period testing positive for SARS-CoV-2 virus during that 14-day time period.”

Governor Ralph Northam today announced the adoption of Statewide Emergency Workplace Safety Standards governors page in response to the novel coronavirus, or COVID-19.
